Trans Mountain pipeline litigation: Tsleil-Waututh Nation v Canada (Attorney General)

The Federal Court of Appeal issued its decision this morning (August 30, 2018) in the Trans Mountain pipeline litigation (Tsleil-Waututh Nation v Canada (Attorney General), 2018 FCA 153). The application for judicial review, launched by several First Nations and the cities of Vancouver and Burnaby, challenged the National Energy Board’s (NEB) report recommending the approval of the pipeline project and the subsequent Governor-in-Council’s Order in Council that accepted the NEB’s recommendations and approved the project.

The court dismissed the judicial review challenge of the NEB’s report but quashed the Order in Council on the basis that the Governor-in-Council could not ‘reasonably rely’ on the NEB’s report given that the NEB’s process and findings were flawed. The court also found that Canada failed to fulfill its duty to consult Indigenous peoples.

You can read the reasons for decision on the court’s website: sleil-Waututh Nation v Canada (Attorney General), 2018 FCA 153

A live stream of representatives from the Squamish Nation and Tsleil-Waututh Nation discussing the decision can be viewed on CBC News.

Research help during summer months

You may have noticed that the research help desk in the law library is unattended during the summer months.

Though the desk is quiet, research and citation help is still available.

Students, you’re encouraged to email or phone the usual research help contacts. The librarians receive email and phone messages at those contacts and will respond as quickly as possible, Monday through Friday.

You may also drop by the librarian offices (room 193 and 197) for research help or make an appointment with a librarian via the staff at the library circulation desk.

Echo the wellness companion dog is back at UVic Law

Have you met the latest addition to the Law Library team?

The library is pleased to welcome back Echo, a black lab retriever, to the law school this week!  Echo is available to JD and law grad students as a wellness companion – part of UVic Law’s and the Law Library’s on-going commitment to student wellness and support.

To spend time with Echo, students must come to the law library loan desk and check out Echo’s care guidelines booklet, call number K9 Echo 2017.

Echo’s availability this week will be between approximately 10:00 am and 3:00 pm daily. Toward the end of this week we will let you know about Echo’s availability into the exam period.

While animals are normally not permitted in UVic buildings,  UVic administration has granted a temporary exception for Echo, with conditions. Please respect those conditions (indicated in the care guidelines booklet). The conditions include that, should a student take Echo outside, the student must take Echo out through the main building doors. Echo isn’t permitted to be in the student lounge or other building areas, including the library, because of allergen concerns.

Remember that Amicus Team support remains available to law students throughout the year and that the law library’s Relaxation Station, is available whenever the library is open.

Exam Period at the Law Library: extended hours and room bookings

With the exam period quickly approaching, we wish to ensure we offer all law students the support and study environment that is needed at this time. We alert all library users to the following updates and reminders:

  • The Law Library will be closed on Friday, March 30 (Good Friday) and Monday, April 2 (Easter Monday).
  • Extended study period and exam hours begin on Tuesday, April 3 and run until Sunday, April 22, inclusive.
  • During this period the law library will be open until 10 pm each night except Fridays.
  • During this period all group study rooms and individual study carrels will be reserved for law student use only.
  • This will continue until law library staff see a significant decline in use by law students, or until April 22, whichever comes first.
  • During this period group study rooms and study carrels may be booked at the loan desk.

Finally, we trust all law library users will respect the increased need for quiet study at this time.
