Foundational Obligations to Indigenous Peoples
Self-Assessment & Training Series Toolkit
These tools take steps toward responding to:
Truth and Reconciliation Comission (TRC) – Calls to Action 43, 57
Call to Action 43: We call upon federal, provincial, territorial, and municipal governments to fully adopt and implement the United Nations Declaration on the Rights of Indigenous Peoples as the framework for reconciliation.
Call to Action 57: We call upon federal, provincial, territorial, and municipal governments to provide education to public servants on the history of Aboriginal peoples, including the history and legacy of residential schools, the United Nations Declaration on the Rights of Indigenous Peoples, Treaties and Aboriginal rights, Indigenous law, and Aboriginal–Crown relations. This will require skills based training in intercultural competency, conflict resolution, human rights, and anti-racism.
Murdered and Missing Indigenous Women, Girls, Two-Spirit, LGBTQQIA+ (MMIWG2SLGBTQQIA+) – Calls for Justice 15.3, 15.8
Call for Justice 15.3: Develop knowledge and read the Final Report. Listen to the truths shared, and acknowledge the burden of these human and Indigenous rights violations, and how they impact Indigenous women, girls, and 2SLGBTQQIA people today.
Call for Justice 15.8: Help hold all governments accountable to act on the Calls for Justice, and to implement them according to the important principles we set out.
BC Declaration on the Rights of Indigenous Peoples ACT (BC DRIPA) – Articles 3.7, 3.8
Article 3.7: Implement recommendations made in the In Plain Sight: Addressing Indigenous-specific racism and discrimination in B.C. health care report, striving to establish a health care system in B.C. that is culturally safe and free of Indigenous-specific racism.
Article 3.8: Develop and implement community-driven activities to end violence against Indigenous women, girls and 2SLGBTQQIA+ people, beginning with the foundational activities in A Path Forward: Priorities and Early Strategies for B.C. and steps towards achieving the mandate commitment to develop a gender-based violence action plan.
In Plain Sight: Addressing Indigenous-Specific Racism and Discrimination in BC Healthcare – Recommendation 3, 15, 16, 22
Recommendation 3: That the B.C. government, First Nations governing bodies and representative organizations, and MNBC jointly establish the position of B.C. Indigenous Health Officer with co-developed legislative recognition and authority in the Public Health Act, and a structured relationship with the Provincial Health Officer.
Recommendation 15: That the B.C. government, First Nations governing bodies and representative organizations, MNBC, the Provincial Health Officer and the Indigenous Health Officer develop a robust Indigenous pandemic response planning structure that addresses jurisdictional issues that have arisen in the context of COVID-19, and which upholds the standards of the UN Declaration.
Recommendation 16: That the B.C. government implement immediate measures to respond to the MMIWG Calls for Justice and the specific experiences and needs of Indigenous women as outlined in this Review.
Recommendation 22: That the B.C. government, in consultation and cooperation with Indigenous peoples, consider further truth-telling and public education opportunities that build understanding and support for action to address Indigenous-specific racism in the health care system;
supplemented by a series of educational resources, including for use in classrooms of all ages and for the public, on the history of Indigenous health and wellness prior to the arrival of Europeans, and since that time.
BC Cultural Safety & Humility Standard – Standard 5.2.2
